Results of the practical check confirm the central role of notaries in the formation of companies and associations
The Federal Chamber of Notaries welcomes the results of the Federal Ministry of Justice's practical check on processes requiring notarization in association and GmbH law (https://www.bmj.de/SharedDocs/Publikationen/DE/Fachpublikationen/2024_Ergebnisse_Praxischeck_Vereins_GmbH_Recht.html?nn=110490). "The report underlines the important role of notaries as a key figure in reducing bureaucratic hurdles for start-ups and proposes establishing them as a central point of contact for the formation of GmbHs and the registration of associations," says Prof. Dr. Jens Bormann, President of the Federal Chamber of Notaries. This further development would not only make processes even more efficient, but would also make a significant contribution to relieving the burden on companies and associations.
The proposal to develop notaries into a "one-stop store" for start-ups is particularly positive. This would enable founders to complete all official procedures in one step, which would make the entire process considerably easier and faster. "Notaries in Germany are happy to help drive forward the digitalization of start-up processes," explains Bormann. The Federal Chamber of Notaries has already proven in the past that it has the necessary expertise for this, e.g. through the introduction of online notarial procedures for start-ups (see here). Another important concern of the Bundesnotarkammer is to support founders of companies and associations, for which it operates two different websites as information platforms (see https://gmbh-gruenden.notar.de/ and https://verein-gruenden.notar.de/).
